Muscat: Businesses importing refrigeration and air-conditioning equipment, aerosol products and other materials covered by ozone protection regulations must obtain prior approval from the Environment Authority (EA), under a new administrative decision aimed at strengthening controls on substances that affect the ozone layer.

The decision sets out requirements governing the import, export and re-export of controlled substances and equipment, while placing new obligations on businesses to document their use and gradually phase out substances subject to restrictions.

The rules cover substances used as alternatives to ozone-depleting materials, as well as refrigerators, freezers, air-conditioning and refrigeration units, water coolers, ice-making machines, aerosol products and fire-extinguishing equipment.

Importers and other concerned businesses must obtain permits before bringing these materials into the country, exporting them or re-exporting them. They are also required to comply with the quantities authorised by the authority.

According to the decision, businesses must submit annual reports detailing the types and quantities of materials they handle, clearly identify cylinders and containers, retain invoices establishing the source of the materials and follow the prescribed schedule for phasing out controlled substances.

The decision also sets clear restrictions on the movement and disposal of these materials. Importing, exporting or re-exporting covered substances without a permit is prohibited, as is importing equipment that relies on controlled substances. Imports of such substances from countries that are not parties to the relevant international protocol are also barred.

The disposal of substances or equipment containing them requires prior approval from the EA, the decision pointed out.

Violations can result in fines of RO25 to RO300, depending on the type and quantity of the material and the nature of the licence. Administrative fines range from RO100 to RO2,000, with penalties increasing for repeat offences.
