Social Protection Law: Maternity leave allowance of 98 days

Muscat: His Majesty Sultan Haitham bin Tarik on Wednesday issued Royal Decree 52/2023 promulgating the Social Protection Law, after presenting the same before the Council of Oman. The Social Protection Fund is an entity with administrative and financial independence established by Royal Decree No. (33/2021).


Maternity leave


The entitlements of the maternity leave insurance program with respect to the maternity leave allowance shall be full-paid for a period of (98) days, of which (14) may be fourteen days prior to the date of delivery.


The remaining leave for the mother to care for the child, and the insured father is entitled to the same leave allowance in the event of the death of the uninsured mother during childbirth or during the aforementioned leave.


The insured woman is entitled to request leave to take care of the child without maternity leave allowance for a period of ninety-eight (98) days within a year from the date of the end of the first period. This leave may be distributed between the insured parents.


The allowance for paternity leave shall be fully paid for a period of (7) days.


Among the eligibility conditions is that the child is born alive or that the pregnancy exceeds the (25th) week.


In the event of the death of the child after the (25th) week, the insured woman is entitled to a leave allowance, and that the maternity leave for the first period does not exceed the (98th) day of the child’s life. In the event of fostering a child deprived of his natural family, if supporting documents are submitted, provided that the age of the child does not exceed (3) months when submitting the leave application.


As for the required documents, they are represented in the civil number, while making sure that the data related to contact in the civil status register are up-to-date, and a request submitted by the employer to the fund to compensate the employer for the salaries and subscriptions paid to the insured during periods of leave, accompanied by supporting documents in addition to supporting documents for pregnancy, and a certificate Birth issued by the civil status, and the application is submitted by the employer.
