

The Primary Court in Al Qabil, North Sharqiyah Governorate, has convicted a vehicle repair shop and its representative after they were found to have violated the Consumer Protection Law in a case concerning their failure to provide proper service as required by law.
The court sentenced both the establishment and its representative to a fine of RO100 each.
The case stemmed from a complaint received by the Consumer Protection Department in North Sharqiyah Governorate from a consumer against a vehicle repair shop.
The consumer explained that he had contracted with the shop to repair a fault in his vehicle.
It was determined that the fault was in the engine, and they agreed to replace it. However, the consumer later noticed an oil leak from the engine.
The supplier purchased the necessary spare parts and repaired the vehicle, but claimed that the new leak was in the transmission (gearbox), not the engine, asserting that the company was not responsible for this fault.
After the problem persisted, another oil leak appeared following the installation of a used engine. The report of the technical expert appointed by the Consumer Protection Department confirmed this.
The leak was caused by a blockage in the engine ventilation system, leading to excessive pressure that caused oil to leak from the engine-transmission junction. Consequently, the consumer filed a complaint with the Consumer Protection Authority, which referred the case to the Public Prosecution. The Public Prosecution initiated an investigation and referred the case to the competent court. The court deemed the incident a clear breach of the service provider's obligation to provide proper service and convicted the defendants of the misdemeanor of the service provider's failure to provide proper service, as stipulated in Article (39) of the Consumer Protection Law.
