Collecting funds from public without permit an offence: MoSD

Collecting money from the public without a permit is an offence and can be punished according to Articles 299 and 300 of the Oman Penal Code, which criminalise the collection of money from the public by any means or inviting them to donate without obtaining a license from the competent authority, as stated by the Ministry of Social Development (MoSD).


The MoSD issued instructions following reports of people attempting to collect money without authorisation. The Ministry emphasises that only authorised individuals or organisations are allowed to collect money, whether for use within Oman or abroad.


A source from MoSD, speaking to the Observer, clarified that the law does not prohibit collecting money for charity. It aims to ensure that donated funds reach deserving recipients and are used according to established guidelines and goals set by donors.


Article 299 of the Oman Penal Code specifies that individuals collecting money without a license may face imprisonment for a minimum of one month and a maximum of three months, as well as a fine ranging from RO 200 to RO 600.


Article 300 states that collecting money from the public without a license and sending it outside Oman can lead to imprisonment for a minimum of three months and a maximum of one year, along with a fine of RO 1,000 to RO 2,000.


Legally approved clubs and organisations, with permission from the MoSD, can collect funds for charitable purposes. However, certain conditions must be met, such as registration with the Ministry and a clear charitable goal.


The ministry has launched the 'Joud' digital platform for charitable donations to support social initiatives. This platform allows individuals and institutions to donate securely and electronically to charitable associations and volunteer teams in Oman. It aims to streamline the donation process and ensure funds reach their intended recipients promptly.


Overall, the regulations aim to prevent unauthorised money collection and ensure transparency and accountability in charitable activities.
