Muscat: His Majesty Sultan Haitham bin Tarik on Tuesday issued 4 Royal decrees, reading as follows:


Royal Decree No (71/2023) promulgating the Public Utility Expropriation Law.


Article (1) states that the Public Utility Expropriation Law attached to this decree shall be enforced.


Article (2) says that the Minister of Housing and Urban Planning shall issue the bylaw (executive regulation) for the attached law after the approval of the Council of Ministers. The minister shall also issue the decisions necessary for the implementation of the law’s provisions. Till such time, the existing regulations and decisions shall be enforced without prejudice to the provisions of the law.


Article (3) annuls Royal Decree No (64/78) on promulgation of the Public Utility Expropriation Law. It also cancels all that contradicts the attached law or contravenes its provisions.


Article (4) says that this decree shall be published in the Official Gazette and enforced from the day following its date of publishing.


Royal Decree No (72/2023) amending some provisions of the Police College’s bylaw.


Article (1) states that the amendments on the bylaw of the Police College attached to this decree shall be enforced.


Article (2) cancels all that contradicts the attached amendments or contravenes their provisions.


Article (3) says that this decree shall be published in the Official Gazette and enforced from the day following its date of publishing.


Royal Decree No 73/2023 transfers “powers related to the revision of contracts” from the Ministry of Justice and Legal Affairs to the Secretariat General of the Tender Board.


Article (1) transfers “powers related to the revision of contracts” from the Ministry of Justice and Legal Affairs to the Secretariat General of the Tender Board, as follows:


1. Reviewing the blueprints of unified model contracts drafted by Units of the State’s Administrative Apparatus and other public legal persons in the instances/circumstances stipulated by law.


2. Reviewing the blueprints of contracts whose value exceeds RO 5 million, as well as related ‘change orders’, irrespective of their values prior to contract signing or whether any unit of the State’s Administrative Apparatus or other public legal persons might have started implementing the projects. The review of instances other than ‘unified model contracts’ covers the procedures that preceded the contract signing process.


Article (2) transfers to the Secretariat General of the Tender Board the Justice and Legal Affairs Ministry’s technicians and legal advisers tasked with reviewing contracts, as well as other staff of the Ministry whose tasks are associated with such revision/review. It also stipulates transferring the above mentioned employees’ status of seniority and financial grades. Existing job nature allowances of the above mentioned employees will be preserved for them in a personal manner.


The transfer shall take place in accordance with the mechanism that will be agreed by the Minister of Justice and Legal Affairs and the Secretary General of the Tender Board.


Article (3) cancels all that contradicts this decree or contravenes its provisions.


Article (4) says that this decree shall be published in the Official Gazette and enforced on its date of issue.


Royal Decree No (74/2023) appointing governors.


Article (1) appoints the following as governors to the governorates indicated along their names:


- Eng Masoud Said Hashim al Hashmi as Governor of South Al Batinah, with the Special Garde.


- Mahmoud Yahya Sulaiman al Thuhli as Governor of North Al Sharqiyah, with the Special Garde


- Shaikh Ahmed Musallam Suhail Jidad al Kithiri as Governor of Al Wusta, with the Special Garde.


Article (2) says that this decree shall be published in the Official Gazette and enforced from its date of issue.
