Photographer gets jail, fine for failing to deliver wedding photos, video

 
A wedding photographer was slapped fine and jail by a court in Al Buraimi after it found that there was a serious violation of the terms of the contract, an official from the Consumer Protection Authority (CPA) said.

The woman was found guilty of failing to provide service to a woman consumer. She was awarded with prison term and a fine equivalent to the consumer’s material losses.

According to the CPA, the case began when a consumer lodged a complaint in Al Buraimi against a photographer and her studio. The consumer had asked the studio to create a photo album and video of her wedding. However, the studio failed to deliver it.

After the Consumer Protection Department intervened, the studio only provided some of the photos and a video. When questioned about the partial delivery, the studio owner claimed that the memory card was damaged. The consumer in her plaint said she suffered both mental and material damages.

The complaint was then transferred to the competent court, which issued its sentence. The woman, who owned the studio, was sentenced to 10 days of imprisonment and a fine of RO 100. The court also ordered the studio to refund RO 300 and another RO 300 for the damages. The studio was also required to pay the legal expenses. The court decided to suspend the criminal penalty against the studio owner if the civil rights were fulfilled within one month from the date of the ruling.

“It is always important to stick to the terms and conditions agreed upon while entering into the contract and to take all the necessary steps to ensure that one can deliver whatever is agreed upon,” said the senior official from the CPA.

The CPA further urged service providers to exercise care in delivering the service properly.
