New rules for compensation in road accident cases

 
A new decision has been issued regarding the Assured Fund for the assistance of persons who suffer physical injuries, heirs of the deceased, and to compensate for material damages in road accidents.

The decision was published in the official gazette on Sunday.

Sultan bin Salem al Habsi, Minister of Finance and Chairman of the Board of Directors of the Capital Market Authority (CMA), issued a decision to amend some provisions of the system of the Assured Fund.

The amendments stipulate that the fund will offer assistance to those with physical injuries, heirs of the deceased, compensation for material damages in the wake of road accidents. The conditions include that there should be a contact or relation between the vehicles causing the accident and the injured.

In case of material damages, the value of the claim should be not less than RO 500, and in the case of treatment or first aid expenses, the total value should be not less than RO 500.

The decision states that the heirs of the deceased or injured or their agents must submit a request for assistance or compensation to the committee as per a specific form prepared, provided that the request includes all data and information related to the claim.

Documents to be attached with the application form include a copy of the final report issued by the Royal Oman Police (ROP) of the accident, a copy of the medical report issued by the Ministry of Health (MoH), a copy of the bills for treatment and first aid expenses from a hospital in the country, a copy of a death certificate for the deceased as a result of the accident, a copy of the legal agency representing the heirs, a copy of a power of attorney in case the request is submitted through an agent, applications submitted two years from the date of the accident shall not be accepted with regard to death and physical injuries.

As for the material damage, the application shall not be accepted unless submitted within six months from the accident.
